TOUR WAIVER RELEASE FORM
PLEASE READ & FILL OUT THE FORM BELOW
Our Release & Assumption of Risk agreement (“Agreement”) must be signed by all parties that are participating in The Movie Guys’ L.A. Film Locations Tour. For children under 18, a parent or guardian must sign on his/her behalf.
A. I recognize that the tours offered by Digital Mind Productions, LLC, a California limited liability company, dba The Movie Guys, will or may involve travel and activities which are, or may be, inherently dangerous to participants and that travel on foot, or by public or private conveyance of any sort, and getting in or out of any public or private conveyance, may result in illness, injury or death which may be caused by, or result from, my own negligence, actions or failure to act of others (including employees or agents of The Movie Guys’ L.A. Film Locations Tour), by accident, physical exertion for which I am not prepared, consumption of alcohol, medications or drugs, natural events or other causes. I understand and accept that the tour involves travelling over paved roads which may be difficult for a person with physical or mental disabilities. I understand that there are hazards traveling by foot outside of the vehicle over the types of terrain described above. I understand that there are hazards in the possibility of forces of nature, including but not limited to, rain, lightning, weather changes, dehydration, hypothermia, sunburn, and winds. I knowingly and willfully accept these risks and take complete and total responsibility for my behavior, well-being, and health during the tour/excursion. I voluntarily accept and assume all risks of loss, damage, or injury that may be sustained while participating in this tour/excursion. I further agree that I have read all the safety and other rules, regulations and instructions or other material given to me either orally or in writing by The Movie Guys’ L.A. Film Locations Tour, and I will abide by them and all generally accepted rules of safety and behavior.
B. In consideration of The Movie Guys’ L.A. Film Locations Tour permitting me and/or my family members to participate in the tours and activities provided by it, and persons associated with it, I hereby release, Digital Mind Productions, LLC, The Movie Guys, Paul Preston and collectively their owners, agents, employees, servants, and independent contractors from any and all claims, demands and liabilities which I now have or in the future may have against it or them which may result from my (or my family’s) participation in the activities covered by, or related to, this agreement. This release and waiver shall be binding on me, my heirs, executors and administrators and all persons claiming under me.
C. I am aware that medical services or facilities may not be readily available or accessible during some of the time in which I am participating in the tour. I understand and agree that medical or other services that may be rendered to me by, or at the insistence of, any of the above parties are not an admission of liability nor of any duty to provide or to continue to provide such services and are not under, nor do they constitute, a waiver by any of the said parties of any right hereunder. I understand that serious accidents may occur and that the participants in this excursion may sustain mortal or serious injury as a result of their participation. Nevertheless, I agree to assume these risks and to release and hold harmless all of the persons mentioned above who might otherwise be liable to me for damages
D. I hereby grant The Movie Guys’ L.A. Film Locations Tour the right to take, and to use in perpetuity, in all locations, for promotional and other commercial purposes, photographic and other records of its tours and participants.
E. This Agreement shall be governed by, and interpreted according to, the laws of the State of California and I agree that any disputes or claims made under it shall be adjudicated in the County of Los Angeles, State of California.
F. I have carefully read this agreement and fully understand its contents. I acknowledge that this agreement contains a release of liability and is a contract between me and the entities and persons named herein and/or their affiliated organizations, and I affirm that I sign it of my own free will and in its entirety.
RULES
In order to ensure the health and safety of our participants, we require all our guests to comply with our Guest Code of Conduct at all times while participating in tours or other activities with Digital Mind Productions, LLC:
1. NO SMOKING or littering.
2. No Alcoholic Beverages are permitted to be brought on the tour.
3. Service animals are welcome with advanced notice. The Movie Guys’ L.A. Film Locations Tour has the right to refuse a guest who is traveling with a service animal and has not notified tour management ahead of time.
4. Children traveling in child safety seats are not permitted on the tour. Children who are legally required to travel in a child safety seat, whether on the basis of age, height, weight, or other, are not permitted to participate in the tour.
5. The nature of the vehicles of the tour may prohibit elderly persons and guests of certain body shapes and sizes from participating.
6. Remain with your guide at all times. If you purposely leave, without the consent of the guide, The Movie Guys’ L.A. Film Locations Tour may end the tour there and then.
7. For safety, you should be in good health and free from back or neck problems or other conditions that could be aggravated by car travel.
8. Photographs, videos and/or film taken by guests during The Movie Guys’ L.A. Film Locations Tour must be for personal use only. Shooting photos or video for commercial purposes is prohibited.
9. The tour may be curtailed or cancelled temporarily because of certain conditions out of our control, such as weather, civil unrest, or fire, if such conditions do not permit safe operation of the tour. No refunds or rainchecks will be provided for cancellations due to inclement weather or Acts of God.
10. Any behavior that disrupts another guest's or employee’s enjoyment or safety or any non-compliance with these Rules or rules of common courtesy and conduct could result in the violator being ejected from the tour without refund.
I have read the above and understand the rules of conduct and will fully abide by them, as well as all additional instructions given by the leadership of this trip and activity directors.
